These Terms of Service ("Terms") govern your access to and use of the MVN Fitness website at mvnhome.com and the MVN Fitness application (the "Service"), operated by Mount Vernon Essentials LLC ("MVN Fitness", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorised use. You agree to provide accurate information and to keep it up to date.

3. Acceptable Use

• Do not use the Service for any unlawful, harmful, or fraudulent purpose.
• Do not attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service or its infrastructure.
• Do not upload content that infringes the rights of others or violates applicable law.

You retain ownership of the data and content you submit to the Service ("Your Content"). You grant us a limited licence to host, process, and display Your Content solely as necessary to operate and provide the Service to you. You are responsible for Your Content and for ensuring you have the rights to submit it.

Some features may be offered on a paid basis. Where they are, pricing, billing cycle, and renewal terms will be presented to you before purchase. Unless stated otherwise, fees are non-refundable except where required by law. We may change pricing prospectively with notice.

The MVN Fitness name, logo, and the design and content of the Service (excluding Your Content and any open-source components under their own licences) are owned by or licensed to Mount Vernon Essentials LLC and are protected by applicable laws. These Terms do not grant you any right to use our trademarks without prior written permission.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Mount Vernon Essentials LLC and its officers, members, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months preceding the claim or USD 100.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Wyoming for any dispute not subject to arbitration or small-claims resolution.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
